Introduction
Fog Data Science LLC (“FDS,” “we,” “us,” or “our”) values individuals’ (“you” or “your”) privacy. In this Privacy Policy (“Policy”), we describe how we may collect, use, store, and disclose your information as it relates to:
Our data services – these are the data products and services that we provide to our Customers (the “Data Services”); and
This website, www.fogdatascience.com (the “Website” or “Site”).
Our customers (“Customers”) are entities that use our Data Services.
Our third-party data suppliers (“Data Suppliers”) are companies from which FDS obtains commercially available data for use in our Data Services. The data provided to FDS is organized around mobile advertising identifiers (“MAIDs”) and may include supplemental information associated with a MAID, as further described in this Policy.
By visiting the Website, you agree that your information will be handled as described in this Policy. Your use of this Site is subject to this Policy.
Please note that this Policy does not cover our Customers’ use of the information we provide to them. Our Customers may associate the information we provide with additional information they have from other sources and may use this combined information for a variety of purposes, such as, security and risk management, law enforcement and national security.
Who We Are
FDS provides real-world location intelligence. Our Reveal Portal merges, categorizes, and interprets disparate Location Data (as defined below). Our Customers rely on our Data Services to power their security and risk management solutions and to understand movement patterns for law enforcement and national security purposes.
Description of Services
FDS obtains and processes commercially available MAID-based data from third-party Data Suppliers. The data received by FDS is indexed by mobile advertising identifier, such as Apple's Identifier for Advertisers (“IDFA”) or Google's Advertising ID (“Ad ID”), and includes location data in the form of latitude and longitude coordinates (“Location Data”) associated with a MAID. Depending on the data provided by a Data Supplier, records may also include supplemental information associated with the MAID, such as Network IP address and Device User Agent Data (as defined below).
FDS's Reveal Portal allows authorized Customers to analyze and visualize Data Services information through our proprietary software tool (the “Portal”).

FDS receives commercially available MAID-based data from third-party Data Suppliers for use in our Data Services. These records are indexed by MAID and may include the following information associated with the MAID:

FDS collects the following information from authorized Customer users, or from a Customer on behalf of its authorized users, to create and administer Portal accounts and support use of the Data Services:

FDS uses information we collect, receive, and process for the following purposes:
Data Services Information. FDS uses MAID-based information received from Data Suppliers to provide, operate, secure, maintain, and improve our Data Services and to support authorized Customers' use of the Data Services.
Website Information. FDS uses information collected through the Website to respond to inquiries, provide information regarding our products and services, conduct marketing and analytics, improve the Website, protect our rights and systems, and comply with applicable law.
Customer Portal Account and Usage Information. FDS uses User Data and Usage Data to establish and administer authorized user accounts, authenticate users, provide customer support, secure and monitor the Portal, administer Customer relationships, and comply with legal and contractual obligations.
Protecting Rights and Interests. To protect the safety, rights, property, or security of FDS, our services, any third party or Data Supplier, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop activity that FDS, in its sole discretion, may consider to be, or pose a risk of being, an illegal, unethical, or legally actionable activity; to use as evidence in litigation; to conduct audits; and to enforce this Policy.
Legal Compliance. To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.
FDS does not use information collected through the Website to populate or enrich the MAID-based datasets used in our Data Services.
4. Supplementary Information for Individuals Residing In Select U.S. States
Under various U.S. State privacy laws, you may have certain additional rights that pertain to your data privacy. These additional privacy laws require FDS to provide individuals with certain information about the processing of their “personal information” and the rights that are available to them under such laws.
Personal Information
Generally, “personal information” is defined as “any information that directly or indirectly identifies, relates to, describes, or can be associated with or reasonably linked to “an individual or household”, including name, address, mobile device identifiers, precise location data, IP and cookie identifiers, inferences, and biometric data.

Personal Information Collected Directly Through the FDS Website and Portal Use
The table below describes personal information FDS collects directly from individuals through the Website or from authorized Customer users through their use of the FDS Portal. It does not describe information FDS receives from third-party Data Suppliers for use in our Data Services. Information received from third-party data suppliers is described in Section 1, “Information We Collect, Receive, and Process,” above.
Additional Information for California Residents
The California Consumer Privacy Act (“CCPA”) requires us to provide California residents with information regarding our collection, use, disclosure, sale, and sharing of personal information. The categories of personal information FDS processes vary depending on whether the information relates to our Website, an authorized Customer user's Portal account and usage, or our Data Services.
Sensitive Personal Information
Certain Data Services information processed by FDS may constitute sensitive personal information under California law. Specifically, precise geolocation information associated with a MAID may constitute sensitive personal information.
FDS receives this information from third-party Data Suppliers and processes it for the Data Services purposes described in this Policy. FDS does not collect precise geolocation information directly from consumers through the Website or from authorized Customer users through their use of the Portal.
California residents may have the right to limit certain uses and disclosures of sensitive personal information as provided by applicable law. Information regarding how to exercise applicable privacy rights is provided below.
California Data Broker Annual Consumer Rights Metrics (DROP Reporting)
In accordance with California Civil Code Sections 1798.99.80 et seq. and applicable California Consumer Privacy Act (CCPA) requirements, Fog Data Science publishes the following annual consumer rights request metrics for the previous calendar year.

Deletion Request Exceptions
California law permits businesses and data brokers to decline deletion requests, in whole or in part, under certain circumstances specified in California Civil Code Sections 1798.145 and 1798.146.
During the reporting period, Fog Data Science determined that deletion was not required for the following number of requests:
Where a deletion request was denied in whole or in part based on an applicable statutory exception, Fog Data Science informed the requesting consumer of the basis for the denial as required by applicable law.
Annual Updates
These metrics are updated annually and reflect consumer rights requests received during the preceding calendar year.
Categories of Sources of Personal Information
FDS receives personal information from the following categories of sources:
Consumers and Website visitors, who provide information directly or interact with our Website;
Customers, including information provided to establish and administer authorized Portal user accounts; and
Third-party Data Suppliers, from which FDS obtains commercially available MAID-based data and associated Data Services information.

Disclosing Personal Information for a Business Purpose
Business Purpose
We may share your personal information with affiliates and service providers for a business purpose, which different privacy laws generally define as the use of personal information for operational or other notified purposes. In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose:

Sale of Personal Information
FDS may sell personal information, as the term “sell” is defined under the CCPA, in connection with our Data Services. During the preceding 12 months, the categories of personal information sold may include Identifiers and Geolocation Data.
Categories of third parties to whom FDS may sell personal information include authorized Customers of the Data Services. Depending on the applicable Customer relationship and authorized use, Customers may include public-sector entities, law-enforcement agencies, government entities, and private-sector organizations using Data Services for security and risk-management purposes.
FDS does not sell Customer Portal User Data or Usage Data collected from authorized users through their use of the Portal.
Many U.S. State privacy laws grant you rights (subject to certain exceptions) with respect to your personal information that companies may hold about you. Each of your rights is outlined in more detail below:
Right to Know. You may have the right to request information regarding the categories of personal information FDS has collected about you; the categories of sources from which the information was collected; the business or commercial purposes for collecting, selling, or sharing the information; the categories of third parties to whom FDS discloses personal information; and other information required by applicable law.
Right to Access/Portability. Subject to verification and applicable exceptions, you may have the right to request specific pieces of personal information FDS maintains about you and to receive the information in a portable format where required by law. For California residents, FDS will respond for the period required by applicable California law, subject to applicable statutory exceptions, including where providing information for an extended period would be impossible or involve disproportionate effort.
Right to Delete. You have the right to ask us to delete or remove the personal information we have collected from you and retained. Upon verifying your request, where verification is required, we will delete your personal information from our records unless an exception applies (for example, where your information helps us comply with a legal obligation, detect or prevent security incidents, or comply with applicable law).
Right to Correct. You may have the right to request that FDS correct inaccurate personal information that FDS maintains about you, taking into account the nature of the personal information and the purposes for which FDS processes the information. FDS may require verification of a correction request as permitted by applicable law.
Right to Opt-Out. Where FDS sells or shares personal information as those terms are defined under applicable law, you may have the right to direct FDS not to sell or share your personal information. A request to opt out of sale or sharing does not require a verifiable consumer request. FDS may request information reasonably necessary to identify the information or device to which the request applies and to effectuate the request.
Right to Limit. Where applicable, California residents may have the right to direct FDS to limit certain uses and disclosures of sensitive personal information. A request to limit does not require a verifiable consumer request. FDS may request information reasonably necessary to identify the information or device to which the request applies and to effectuate the request.
Verification of Consumer Privacy Requests
The information FDS requires to verify a consumer privacy request may vary depending on the information to which the request relates. FDS uses commercially reasonable methods appropriate to the nature of the personal information and the type of request.
Website Information. For requests relating to information collected through our Website, FDS may verify the request using information previously provided by the consumer or other information reasonably necessary to verify the request.
Customer Portal Account and Usage Information. For requests relating to an authorized Portal user, FDS may verify the request using account, email, Customer relationship, or other information associated with the Portal account.
Data Services Information. Data Services records received from third-party Data Suppliers are indexed by mobile advertising identifier (“MAID”). FDS does not maintain Data Services records indexed by consumer name, email address, telephone number, mailing address, or other traditional consumer identifiers. Accordingly, FDS may require a MAID associated with a device to locate potentially responsive Data Services records and verify a request to know, access, delete, or correct personal information, where verification is required.
If FDS cannot verify a request using commercially reasonable methods, FDS may deny the request in whole or in part as permitted by applicable law. Where a request for specific pieces of personal information cannot be verified, FDS will evaluate the request in accordance with applicable requirements governing requests for categories of personal information.
Information provided for verification will be used solely for the purpose of verifying and processing the consumer privacy request and for maintaining records necessary to demonstrate compliance with applicable law.
How to Exercise your Rights
Requests to Know, Access, Delete, or Correct. To submit a request to know, access, delete, or correct personal information, please contact FDS at info@fogdatascience.com.
Requests to Opt Out of Sale or Sharing. To submit a request to opt out of the sale or sharing of personal information, please complete the Opt-Out Form available on our Website.
Requests to Limit Use and Disclosure of Sensitive Personal Information. Where the right to limit applies, you may submit a request by emailing info@fogdatascience.com.
We may need to request specific and/or additional information from you to help us verify your identity and ensure your right to access or delete your personal information.
We will only use this information to verify your identity or authority to make the request. An authorized agent submitting a request on behalf of a consumer must demonstrate that the consumer provided written permission, signed by the consumer, authorizing the agent to act on the consumer’s behalf. For requests for information and deletion, FDS may require that the consumer verify their identity directly with FDS and confirm that the consumer authorized the agent to submit the request.
We will deliver our written response electronically. We will not charge you a fee for access to your personal information (or to exercise any of your other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, excessive, or manifestly unfounded, or refuse to comply with your request in such circumstances.
We will not be obligated to respond to more than 2 requests for data access/data portability in a 12-month period, except as otherwise required by applicable law.
Non-Discrimination
Privacy laws prohibit discrimination against individuals for exercising their rights and impose requirements on any financial incentives offered to individuals related to their personal information. FDS will not discriminate against you for exercising any of your privacy rights.
5. Our Use of Cookies and Other Tracking Mechanisms
We use cookies and other tracking mechanisms to track information about your use of our Site. We may combine this information with other information we collect from you.
Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies help you navigate our Site and Data Services more easily, while others enable a faster login process or help us track your activities on our Site and Data Services. There are two types of cookies: session and persistent cookies.
Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to uniquely identify you during a session or while you are logged in to the Site. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Site.
Persistent Cookies. Persistent cookies remain on your computer after you have closed your browser or turned off your computer. We may use persistent cookies to collect aggregate and statistical information regarding Website activity and to help us understand and improve Website performance and user experience.

7. Security of Your Information
We have implemented appropriate administrative, technical, and physical safeguards to protect the information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee security.
8. Privacy Choices
Data Services Opt Out. If you would like to opt out of the sale of MAID-based Data Services information associated with a device, please complete the Opt-Out Form available on our Website. Data Services records are indexed by mobile advertising identifier (“MAID”), and the Opt-Out Form requires only the MAID necessary to identify the device-specific information to which the request applies and to effectuate the request. FDS does not require identity verification to submit an opt-out request.
An opt-out applies to the MAID submitted with the request. If you use multiple devices, a separate MAID may need to be submitted for each device. If a device's MAID is reset, the new MAID is a different identifier and may require a separate opt-out request.
You may also adjust location and tracking permissions on your mobile device to limit future collection of location or advertising-related information by mobile applications and other third parties. Adjusting device settings does not constitute an opt-out request submitted directly to FDS.
Email Marketing Opt Out. You may opt-out of receiving promotional communications from us by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt out of receiving promotional emails about recommendations or other information we think may interest you, we may still send you emails about your account or any services you have requested or received from us.
9. Retention
We keep your personal information for the retention periods laid out below, unless we are required to retain it for a longer period for national security reasons or a legal compliance purpose.
We retain Personal Information used for our Data Services for three years.
We retain Personal Information that is not used for our Data Services for a time period required or allowed by applicable regulations or laws and as needed to fulfill business purposes outlined in Section 2, including providing you products and services, complying with our legal obligations, resolving disputes, and enforcing our agreements, or for other purposes described in this Privacy Policy. Our retention of information is based on many factors such as your relationship with FDS, the nature of the information, compliance with our legal obligations, and defending or resolving actual or anticipated legal claims.
10. Children
Our Services are not designed for children under 16. If we discover that a child under 16 has provided us with personal information, we will delete such information from our systems.
